Terms and conditions of the ChiptuningKRK.pl online store

§ 1 General provisions

  1. The Regulations define the rules for the sale of services and products offered under the domain www.chiptuningkrk.pl (hereinafter referred to as the "Store").

  2. The store is run by Mr. Jan Piszczek, running a business under the name Chiptuning Garage, with its registered office at 70 Ciepłownicza Street in Krakow, NIP 6783191998, REGON 522287173.

  3. The Regulations are available on the Store's website in the "Regulations" tab and constitute an integral part of contracts concluded in the Store.

§ 2 Definitions

  • Customer – a natural person, legal person or organizational unit making a purchase in the Store;

  • Consumer – a natural person concluding a contract not directly related to his or her business activity;

  • Product / Service – chip tuning, diagnostics, software, ECU files, other offered components and products;

  • Sales/Service Agreement – ​​an agreement concluded between the Customer and the Seller by placing an Order;

  • Order Form – interactive procedure for placing an order via the website;

  • Account – user account in the Store system, accelerating future purchases;

  • Privacy Policy – ​​a document specifying the principles of personal data processing.

§ 3 Account and registration

  1. Account registration is optional – the customer can place an order without creating an account.

  2. Registration requires your name (or company name), email address and password.

  3. The customer must accept the Terms and Conditions before using the account.

  4. The account may be deleted at the Customer's request, without giving any reason.

§ 4 Placing an order

  1. Orders can be placed:
    a) online via the order form;
    b) by e-mail;

  2. If you register or place an order without an account, you must provide the data necessary to complete the order.

  3. The Customer selects the Product, confirms the data, accepts the Terms and Conditions and places the order.

  4. Once your order has been placed, you will receive an email confirmation with instructions on how to proceed .

  5. The store may refuse to process an order in the event of incorrect data or suspicion of abuse.

  6. By purchasing digital products (e.g. ECU files, software, maps, PDF instructions), the Customer agrees to immediately start processing the order within 14 days of its conclusion.

  7. The Customer acknowledges that upon delivery of digital content, he or she loses the right to withdraw from the contract pursuant to Article 38, paragraph 1, point 13 of the Act of 30 May 2014 on consumer rights.

  8. Consent to the loss of the right of withdrawal is granted by checking the appropriate box during the purchase process.

§ 5 Prices and payments

  1. All prices are expressed in Polish zloty and include VAT.

  2. The cost of delivery or other services specified when placing the order is added to the price of the order.

  3. Available payment methods: fast online transfers, card payments.

  4. In the case of payment in advance, execution takes place after the funds are credited to the Seller's account.

§ 6 Order fulfillment

  1. The order completion date is indicated on the Store website or in the confirmation e-mail.

  2. Orders placed on weekends and public holidays are processed on the first business day following the event.

  3. If the Product is unavailable, the Store will inform you about the expected delivery time or propose a replacement.

§ 7 Withdrawal from the contract (consumer law)

  1. The consumer has the right to withdraw from the contract within 14 days of receiving the Product without giving any reason, in accordance with the Consumer Rights Act.

  2. To exercise the right of withdrawal, the Consumer must submit a declaration in writing or by e-mail to the Seller.

  3. The return costs are covered by the Customer, unless the Seller decides otherwise.

  4. Refunds will be made within 14 days of receipt of the returned Product or confirmation of its shipment.

  5. The right to withdraw from the contract does not apply to the Consumer in relation to the contract:

a) for the delivery of digital content that is not recorded on a tangible medium, if the performance of the service began with the express consent of the Consumer before the expiry of the withdrawal period and after the Seller informed him of the loss of the right to withdraw from the contract,

b) for the provision of services, if the service was fully performed with the express consent of the Consumer before the expiry of the withdrawal period,

c) the subject of which is goods delivered on special order (e.g. files prepared on individual request).


§ 8 Complaints

  1. The Customer may file a complaint regarding a Product or Service if it is inconsistent with the contract or has defects. Complaints will be processed in accordance with applicable law and these Terms and Conditions.

  2. Complaints can be filed:
    a) by e-mail to: chiptuning@garage.hub.pl ;
    b) via the complaint form in the Customer Panel.

  3. The Seller will consider the complaint within 14 days of its submission.

  4. In justified cases, repairs, replacement of the service or a refund are possible.

§ 9 Privacy Policy

  1. The Seller processes Customers' personal data in accordance with the applicable Privacy Policy, available on the Store's website.

  2. Data is processed for the purposes of order fulfillment, contact, billing, customer service and in the legitimate interest of the Seller (statistics, marketing).

  3. The customer has the right to access, correct, limit processing, object, transfer and delete their data.

  4. Data may be transferred to subcontractors providing services (couriers, IT companies) only to the extent necessary to perform the contract.

§ 10 Data protection and cookies

  1. The store uses technical and organizational measures to protect personal data.

  2. The store uses cookies to improve site functionality, order fulfillment, and analytics.

  3. Detailed rules for the use of cookies and User rights are described in the cookie policy.

§ 11 Intellectual Property

  1. All content available on the Store website (text, photos, logos, descriptions) is the property of the Seller or cooperating entities.

  2. The customer may use them only for personal purposes.

  3. Any copying, distribution or commercial use without the Seller's consent is prohibited.

§ 12 Limitations of Liability

  1. The Seller is not liable for interruptions in the operation of the Store resulting from force majeure, actions of third parties, or failures of the Customer's technical infrastructure.

  2. The Seller is not liable for damage resulting from improper use of the Products or services by the Customer.

§ 13 Final provisions

  1. The Regulations may be changed – the Client will be informed of each change in due time.

  2. In matters not regulated, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.

  3. Consumer disputes will be resolved by the court with jurisdiction over the Seller's registered office. Consumers may also use out-of-court dispute resolution methods (e.g., the ODR platform).
