§ 1 General Provisions

  1. These Terms and Conditions define the rules for selling services and products offered under the domain www.chiptuningkrk.pl (hereinafter: "Store").

  2. The Store is operated by Mr. Jan Piszczek, conducting business under the name Chiptronik Jan Piszczek, with its registered office in Krakow, ul. Mariana Domagały 31A/6 30-741, and a stationary service point at ul. Ciepłownicza 70 in Krakow, Tax ID 6783191998, Statistical ID 522287173.

  3. The Terms and Conditions are available on the Store's website in the "Terms and Conditions" tab and constitute an integral part of agreements concluded in the Store.

§ 2 Definitions

  • Customer - a natural person, legal entity, or organizational unit making a purchase in the Store;

  • Consumer - a natural person concluding an agreement not directly related to their business activity;

  • Product / Service - chip tuning, diagnostics, software, ECU files, other offered items and products;

  • Sales / Service Agreement - an agreement concluded between the Customer and the Seller by placing an Order;

  • Order Form - an interactive procedure for placing an order via the website;

  • Account - a user account in the Store's system, facilitating future purchases;

  • Privacy Policy - a document defining the rules for processing personal data.

§ 3 Account and Registration

  1. Account registration is optional - the Customer can place an order without creating an account.

  2. Registration requires providing a name and surname (or company name), email address, and password.

  3. The Customer must accept the Terms and Conditions before using the account.

  4. The account may be deleted at the Customer's request, without stating a reason.

§ 4 Placing an Order

  1. Orders can be placed:
    a) online via the order form;
    b) by email;

  2. When registering or placing an order without an account, it is necessary to provide data required for order fulfillment.

  3. The Customer selects a Product, confirms the data, accepts the Terms and Conditions, and places an order.

  4. After placing an order, an email with confirmation and instructions for further steps will be sent.

  5. The Store may refuse to fulfill an order in case of incorrect data or suspected abuse.

  6. By purchasing digital products (e.g., ECU files, software, maps, PDF instructions), the Customer agrees to the immediate commencement of order fulfillment before the expiry of 14 days from its conclusion.

  7. The Customer acknowledges that with the delivery of digital content, they lose the right to withdraw from the contract based on Article 38(1)(13) of the Act of May 30, 2014, on consumer rights.

  8. Consent to the loss of the right to withdraw from the contract is given by checking the appropriate checkbox during the purchase process.

§ 5 Prices and Payments

  1. All prices are expressed in Polish Zlotys and include VAT.

  2. The cost of delivery or other service specified during the order placement is added to the order price.

  3. Available payment methods: fast online transfers, card payment.

  4. In case of advance payment, fulfillment takes place after the funds are credited to the Seller's account.

§ 6 Order Fulfillment

  1. The order fulfillment time is indicated on the Store's website or in the confirmation email. Not longer than one business day. Usually up to 1.5 hours.

  2. Orders placed on non-working days and holidays are fulfilled on the next business day.

  3. In case of unavailability of the Product, the Store will inform about the expected fulfillment time or propose a substitute.

§ 7 Withdrawal from the Contract (Consumer's Right)

  1. The Consumer has the right to withdraw from the contract within 14 days of receiving the Product without giving any reason, in accordance with the Consumer Rights Act.

  2. To exercise the right of withdrawal, the Consumer must submit a declaration in writing or by email to the Seller.

  3. The costs of return are covered by the Customer, unless the Seller decides otherwise.

  4. Payment refund occurs within 14 days of receiving the returned Product or confirmation of its shipment.

  5. The Consumer is not entitled to withdraw from a contract regarding:

a) the supply of digital content not stored on a tangible medium, if the performance began with the Consumer's express consent before the expiry of the withdrawal period and after being informed by the Seller about the loss of the right to withdraw from the contract,

b) the provision of services, if the service has been fully performed with the Consumer's express consent before the expiry of the withdrawal period,

c) items delivered made to special order (e.g., files prepared for individual order).


§ 8 Complaints

  1. The Customer may lodge a complaint regarding a Product or Service if they are not compliant with the contract or have defects. Complaints are considered in accordance with applicable legal provisions and these Terms and Conditions.

  2. Complaints can be submitted:
    a) by email to: chiptuning@garage.hub.pl;
    b) via the complaint form in the Customer Panel.

  3. The Seller will consider the complaint within 14 days of its submission.

  4. In justified cases, repair, service replacement, or refund is possible.

§ 9 Privacy Policy

  1. The Seller processes Customers' personal data in accordance with the applicable Privacy Policy, available on the Store's website.

  2. Data is processed for the purposes of order fulfillment, contact, settlements, customer service, and in the legitimate interest of the Seller (statistics, marketing).

  3. The Customer has the right to access, correct, restrict processing, object to, transfer data, and delete their data.

  4. Data may be transferred to subcontractors performing services (couriers, IT companies) only to the extent necessary for contract fulfillment.

§ 10 Data Protection and Cookies

  1. The Store uses technical and organizational measures to protect personal data.

  2. The Store uses cookies to improve website functionality, fulfill orders, and for analytics.

  3. Detailed rules for using cookies and Users' rights are described in the cookie policy.

§ 11 Intellectual Property

  1. All content available on the Store's website (text, photos, logos, descriptions) is the property of the Seller or cooperating entities.

  2. The Customer may use them only for personal purposes.

  3. Any copying, dissemination, or commercial use without the Seller's consent is prohibited.

§ 12 Limitation of Liability

  1. The Seller is not responsible for interruptions in the operation of the Store resulting from force majeure, actions of third parties, or failures of the Customer's technical infrastructure.

  2. The Seller is not responsible for damages arising from improper use of Products or services by the Customer.

§ 13 Final Provisions

  1. The Terms and Conditions may be changed - the Customer will be informed of any change with appropriate advance notice.

  2. In matters not regulated herein, Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.

  3. Consumer disputes will be resolved by the court locally competent for the Seller's registered office. The Consumer may also use out-of-court dispute resolution methods (e.g., ODR platforms).
